Gadon to those claiming BBM did not settle tax penalty: ‘Mga bobo!

Would not dignify disbarment case against him

SENATORIAL aspirant, Atty. Larry Gadon, demolished the claim by critics and enemies of presidential front runner, former Sen. Ferdinand ‘Bongbong/BBM’ Marcos Jr., the latter failed to settle his tax obligations as reported by online news site, Rappler’ last December 3, 2021, based on a certification issued by the Quezon City Regional Trial Court to the petitioners for Marcos’ disqualification before the Commission on Elections.

“Of course, wala talagang record ng compliance ang RTC,” Gadon said.

“When the case was remanded by the Supreme Court down to the Regional Trial Court, the RTC should issue an order of compliance, then the payment should be made to the Bureau of Internal Revenue (BIR), hence no record of payment in RTC because it is not the collecting agency.

“Then the actual turnover of (Marcos) payment is thru the accredited bank of BIR, hence there is not record of payment at the RTC,” Gadon explained, adding, “Mga bobo kasi.”

Gadon was referring to the groups who tried to make a case over the certification last December 2, 2021, issued by Branch 105 of the Quezon City RTC that handled the BIR’s tax complaint against Marcos in 1995.

One of the petitioners, Atty. Theodoro Te, said they would use the court’s certification, signed by Branch 105 officer-in-charge, Rowena Sto. Tomas-Bacud, as evidence against Marcos before the Comelec.

The petitioners against Marcos have been using the BIR tax case to argue for the cancellation of his certificate of candidacy for president and thus remove him from the presidential race, on the ground of “moral turpitude.”

But as evidence, Gadon, showed a copy of a January 4, 2001 letter by the law firm of Sales, De Leon, Tecson and Desiderio, addressed to Atty. Ramon Wilfredo Pagarigan, head of the BIR’s Collection Enforcement Division, of their client’s settlement of his tax obligations. Attached to the letter is a receipt from the Land Bank of the Philippines (LBP) dated December 27, 2001, in the amount of P67,137.27.

“This payment is by way of complete and full satisfaction of our client’s tax liabilities as your office computed pursuant to the decision dated 31 October 1997 of the Court of Appeals in CA GR 18569 (People of the Philippines versus Ferdinand R. Marcos Jr), the lawyers’ letter reads.

In a separate statement, Gadon also said he would not bother to dignify the latest disbarment case filed against him by known Aquino partisan, Jover Laurio and several unknown anti-AIDS groups.

“I don’t even need to file an answer; it should be (the late president Noynoy Aquino) who should file the case, not the ugly face Jover Lauriat (Laurio) who only wants publicity.

This case is probably the 5,638 case of disbarment against Larry Gadon, which I do not even bother to file an answer because they are all nuisance cases,” the hard-talking candidate said.

“My name is still in the Roll of Attorneys of the Supreme Court. You may check the SC website,” Gadon advised.

Gadon is being sued for remarking that Aquino also contracted HIV, the first stage of AIDS, before he died last June 24, 2021. Gadon made the remark in a radio program days after Aquino’s death but was only sued before the Supreme Court last December 2, 2021.
